Similar, but not the same: They actually gave people an option to opt out of the binding arbitration (by sending them a letter). Microsoft seemingly does not.

No they did it shortly after the US supreme court ruled it legal in another case. And Microsoft is one of the many that follows.

Stupidity has nothing to do with it, as the corporations are likely to gain a lot of additional clout when it comes to consumer-related issues via actions such as this...if there's a loser here it sure isn't them. If there's any quality to criticize here it's the government's enabling and/or the citizenry's (by-and-large) complacency.
