Similar, but not the same: They actually gave people an option to opt out of the binding arbitration (by sending them a letter). Microsoft seemingly does not.

Stupidity has nothing to do with it, as the corporations are likely to gain a lot of additional clout when it comes to consumer-related issues via actions such as this...if there's a loser here it sure isn't them.
