I was in an auto accident earlier tonight...

Post by TWITCHDOCTOR »

I'm ok...I think. Things happend around 12:00(roughly 4 hours ago)
My hands are still shaking while I type this message.

I went to a "meet" with the car club that I'm about to join. Yes, my Chevelle WAS/IS involved!!

Long story short, I was STONE COLD sober. I havent had a beer in two days even though there was much drinking at the meet/party..

I'm at this "meet/party" to meet some of the other guys in the club.
There's this 41 year old drunk hotshot with a VERY FAST Chevy S-10(new member/new in town)...he wants to race me. I told him "Nah, not tonight". ANyway, we're all there for a little while, and some of the guys want to leave to go hang out at a local parking lot. Two cool guys that I just barely met that evening(ones in the club, the others a neighbor). They ask me to give them a ride home since thev'e been drinking a little. Its on the way, so I say sure, no problem.

I'm driving em home about six blocks away(following all traffic laws) and park at the curb to let them out. We'll the crazy fuckin asshole in the S-10 turns at the corner and NAILS IT! He probably hit at least 90MPH in a residential street. His skid marks went around 70yards(no shit) RIGHT TOWARDS ME!
He rearended me in my Chevelle with two passengers(witnesess).

My car is kinda fucked...the impact may have bent the frame.
My rear bumber needs to be replaced, tailight, trunk, rear quarter panel,battery,fan...all my chrome assesories on the engine are now eaten away from the battery acid.

The impact was so severe that it knocked the keys out of my ignition and where found in the back seat. The car was still running and the starter was ingaged from impact...thus stripping the teeth. I had to find the keys to turn the car off, which took about a minute. The car almost(could have caught on fire!)

The battery fucked up the fuel pump and it also got some serious gashes in it from the fan when it launched from impact. This is what sprayed acid all around under the hood.fucking the chrome plated shiny goodness.

The two guys were just about to get out of the car when this happend.
My car was ended up resting somewhat in the neighbors yard...dickheads truck is totalled. The hood and front end met the windshield. I'm surprised he was ok.

Thats not even the end of it!!!!!!!!!!!!!!!!!!!!!

He wanted to fight with me even pushed me. I should have killed him!!! Seriously, I was in shock and was remarkably cool headed.
I asked him if he had insurance...his reply was NO! Not even liability!!!!
He mentioned that he has 3 DWI's already and has been in prison before.

The passenger that was riding in the back(my Chevelle) actually got into a fight with Mr. S-10. They almost killed each other. This is a complete stranger sticking up for me.

I'm a nice guy and didn't call the police...to give drunk fuckhead a "get out of jail free card" so to speak. Has was DRUNK AND stupid. He will either pay for my damages or I will take him to court. My two witnesess will go as well on my behalf.

He has no insurance, and no transportation...I may never get my car fixed unless I do it myeslf.
DAMN, and I seriously just got it running good!

I could also be hurt and not know it.
I guess I 'll feel it tomorrow after all the shock adrenaline wears thin.

Guys, sorry to say it, but maybe I should have stayed home once again to play video games.

God...somebody could have been killed...

Seriously though...I have a headache, I think stress related, but my back does feel a little stiff/sore...like if I lifted something heavy. I'm starting to worry about MY situation now, and not so much my cars condition...

I'll keep you guys posted. I feel as though my "nine lives" are running out!

Well, at least you are alright. Just keep an eye out for anything strange though, notify your doctor. It's true that you won't feel any pain until later, sometimes much later, and there can be internal damages.

I got hit a few months back while walking through the street when one motorbike jumped the red light and crashed into me. The bike lost balance and toppled but strangely it only pushed me backward 15 feet or so, while I'm still maintain almost the same standing posture. And I didn't feel any pain either. I felt like I was an ESPrade character :D and that only took out one heart, hardly matters.

But then the pain came after 3 days, and I later knew that I fractured a few ribs and my left hand, but none of those bones break right out so I didn't feel horrible right away.
This causes to me a sensation of badness. - Stormwatch

ACK! Twitch, don't think about it. Get that moron to court. Today it was your car, (and sorry about it happening) tomorrow could be two kids getting splattered by Mr. Stupid.

Get your ass straight to the doctor/hospital and get youself checked out!
And personally I would have reported the drunk fuck to the police straight away. Nobody seems to have been injured this time, but next time he could end up killing someone. If he has a history of drink driving then it's GUARENTEED that he will do it again, so it's only a matter of time.

Funny you should mention that Spec.
There were at least 25 people at the "meet/party" and kids were there.
Hotshot was showing off(like he always does) in front of the house with cars lining the street. The street is very narrow, only room enough for ONE car to pass. Think subdivision here...lots of houses with short windy roads.

I got hit by him when he was racing down another side street a few blocks away. No turns or "blindspots"...its a straight-a -way through street.

I've seen Mr. Stupid in his S-10 before racing down the street behind my house. This guy doesn't learn...with 3 DWI's(Driving While Intoxicated) .
He's new to the club, and is known as a "reckless crazy driver" even when sober...if in fact, he ever is.

Right now guys I have a lot a planning to do tomorrow, I hope everything will be ok. I kinda feel intimidated (yea, even the TwitchDoc) as well as "lost".
The few friends he has look like ex cons...most likely are.

My fucking back is sore! Really, and I'm not a "gold digger" either.
I could have put this guy back in prison with a simple accident report, but I didn't.
I'm a cool fuckin dude, I just hope people will return the favor!

Going to bed now, later...
Any advice will be appreciated.

I agree with ord dude.

I'm sorry to hear about your car twitch thats the sort of shit I have nightmares about. Respect to you for keeping a cool head.

This guy has no insurance right, could he actually afford to pay the damages? I doubt it. Either take him to court or phone the police.

The 2 passengers your witnesses, would they consider doing either of those things themselves, they could have been killed in the backseats.

I've been intimidated before by boy racer assholes like that, the chav uneducated done up little car hard men that frequent nite clubs who steal the innocent teenage girls from good guys but ex cons have nothing to lose by hurting people most of the times their lives are already over. I realise you live in texas where people have guns so I'd be afraid of getting seriously hurt.

Drink driving
no insurance
anti social behaviour
reckless driving in public area
over speed limit
worn tyres
repeated offender
physical assault

this guy has done alot of crimes the police could jail this fukker for a long time with that stuff you have prove and witnesses. Does mr s-10 know where you live?

That sucks badly - really sorry to hear it! Not only has it possibly busted you up, but I know how much work you put into that car too.

Don't let him get away with it - is it still too late to make a report to the cops? As someone said - last night it was you, next time it's going to be someone else who may not be lucky enough to be in a car at the time.

Isn't insurance a legal requirement over there? In the UK, you can't put your car on the road without tax - this gets spotted when missing or expired. To get the tax, you need a valid road test certificate for the car, and valid insurance in your name, matching the ownership documents.

There are still ways around it, but it's not easy here.

Thats pretty fucked-up mate. I'm firmly in the camp that says you should report this prick to the cops. The fact that this guy just hit you apropos of nothing and that he's got so many previous offences to his name says that he's got pretty much no respect for human life.Shop him, because the next poor sod that he turns on might not be so lucky.

He's an asshole and your kindness is wasted on people like that.

Sorry to hear that Twitch, especially since most people here know what your car meant to you.

Seriously, get yourself to the doctor and make shure that you are alright, then after that go straight to the police and report the guy, so he'll be taken to court. He seems like one of the people who will never learn anything and who won't show a hint of responsibility, so he obviously needs to be kept off the streets.

Cannot even sleep.
Back feels better from laying down.
Insurance is the law here...without it, you cannot legally drive.
I agreed to leave the police out of it as long as he pays for the damages.
By me turning him in, it won't help as hes been locked up before...but he's still hasen't learned I guess.

His fines would be WAY too high,(not having insurance can run around a $1,500.00) Drunk and driving? Fines could be up to $10,000.00.(plus automatic prison time) and I would never see any money from him due to his excessive fines. At least if I help keep him out of jail, he might be decent enough to pay for some shit he owes. I'm sure he realizes it, but he owes me BIG TIME. Also, the fact that there are witnesess he really cannot lie about anything.
Either way, if he goes to jail or not, most likely I'll be screwed. If he refuses to do his part, I WILL take him to court. AT least he won't be getting fucked in the ass again in prison, and the court will force him to pay the damages.

Then again, I'm still freaked out, and I'm probably not thinking my best.
I just want to do the right thing, and not screw anybody over in the process. I really feel like I'm doing the right thing here.

The damage to my car is really not that bad...that is, if the frame isn't bent. Bent frame means= car will never drive straight.
I have friends that can do the repair work, and even I am pretty good with this type of stuff myself. Damage could be a couple thousand(at least) to a person "not in the know".
If this guy pay's up, I can do everything or have it done for, hopefully less that $1000.00.
Thats not including paint though...
(rear quarter panel and trunk lid) The trunk has the "SS" stripes and painting stripes will cost more.

Then again, my transmission could also be damaged from the impact due to "force". (its a racing transmission too...not even 200 miles on it)

His truck is totalled, I don't think he will be able to drive it again...he's already paying the price...some people thought he plowed into a tree!

Still, Chevy S-10 pickup trucks are common and are only worth a couple grand(mid to late 80's)...my Chevelle is an "antique muscle car" thats worth at least 10 grand!(37 years old and rare) In fact, just last week I turned down an offer for 10gees!

I swear, I was pretty fucking calm about it all. He was too drunk to talk to, and I didn't insult or offend him in any way shape or form. But yet he was the agressor...the fucking idiot actually pushed me twice! (provoking a fight)
I pushed him away and yelled at him," Hey, don't fuckin touch me again!"
If I honestly get that kind of treatment again, fuck him, I'm going straight to the cops and I'm spilling ALL those beans.

He actually refered to me as a "quero". Which has happend before by some other dumbass from another non-related incedent). I fucking hate that term. I get offended by it. This town is loaded with dumb ass, ignornat alcholic mexicans I swear!

Also, forgot to mention that I do have insurance...just not "full coverage". In other words, "liability". My insurance only protects me if I injure someone else in an accident.

Holy s**t. Glad you're allright...

I doubt I could have stayed cool in that sort of situation... I'm pretty sure I would have lost it. I'd personally have called the police, but if he had no insurance at all... well, I don't know.

Twitch, being mexican myself, I am ashamed of that kind of people giving a bad name to the rest of us living here in the US (don't worry, I am not offended by your comment. You have reason enough to be pissed). Report him to the police. That's the only way he and other lowlifes like him will ever learn. He will NOT pay you. I guarantee you that. Phew, thank goodness you're okay.

But as others have said, this really wasn't an accident...this guy was not only going too fast, but had boozed himself up...he was asking for it. You weren't. You have witnesses of what happened; make sure that this guy pays every last red cent of what he owes you, and is kept off the road until he can clean up his act.

Best part of this is that you came out relatively unharmed! :D
Otherwise though you have been much too easy on the dickhead!
Zero tolerance for DWI!
Couldn't agree more! Getting yourself in danger is one thing, but taking the risk of harming other people too is just NOT DONE..ever!

You have 2 witnesses who sound like people that'll support you if you sue the dickheads ass! So just do it!

If it doesn't help you pay for your bills to get the car back in good state... we could have a fund raiser here... ;) :D

Twitch -

I'm glad to hear that so far you are ok. Usually the body is sore after a sharp impact similar to what you had. You are probably ok, but I'd get a professional opinion if I were you. If something IS detected as being wrong (tweaked vertabrae, etc), it's one more thing you can pin on Asshole.

File a police report. I'm not a lawyer, but this sounds like something that could bite you in the ass later if you are trying to get your car paid for by Asshole. More-so, it will serve as proof that *he* hit you. Not the other way around.

Go back and take pictures of the skid marks and impact marks and lay out a ruler to mark the distance between them to help link to the distance between his tires. Take close-ups of possible tred marks on the road to match with his wheels.

Take pictures of everything. Your car's outside, inside, damage, his truck if you can get near it (dunno if you want to be around Asshole).

There is no way you can make this guy pay if you do not get the law involved. He could easily slip away and you will be screwed and VERY angry.

Fuck not trying to screw him over. He almost killed you and two others. I personally have a very grim look on those convicted of drunk driving and causing accidents while doing so...

Did he give you his phone #? License #? Do you have his plate #?

He almost killed you. He was drunk. He was violently agressive towards you. Fuck him. Throw the law at him. Fuck drunk drivers. He's most likely not going to be able to pay you back for your damages. You have to get the law involved.
Isn't insurance a legal requirement over there?
Yes, it is. But as with all laws, not everybody follows it. Not to be racist or anything, but at least back in my home town a lot of the illegals (mostly hispanic (mexican)) do not. And that fucks you over BIGTIME. (Not trying to offend you Specineff, but it's the truth where I come from)

Oh, and congratulations on staying completely calm. That's the best thing you could have done.

Insurance may well be a legal requirement here but after some uninsured dick head drove into the back of my car last year, the police told me that at least 50% of drivers round here (Liverpool) are uninsured. Quite whether this is true or not I dont know, although it wouldn't surprise me.

Twitch, you should definatly get yourself checked out by a doctor. And get that jerk-off put away. Do you really care that much if he's getting pounded in the ass in prison? He surely deserves it, putting peoples lives in danger by drink driving.
