No most doujin is as unlawful to produce and sell as it would be anywhere else. also more often than not neither ZUN nor anyone else at comiket actually gets anything except publicity (e.g. Milestone)
For comercial works they are licensed. That's just some plushies, figures and the offical manga and books.
ZUN allows nearly all derivative works (ripping music and art straight out of the games is forbidden, as is spoiling the game endings), so long as they are sold as doujin, at conventions and speciality shops, self funded etc. .
It's not unique in doing this, there's similar usage clauses attached to a few of the larger eroge brands.
