Instagram: all your photo are belong to us

Post by Ruldra »

Not sure how many people here actually uses Instagram, but this is something worth mentioning.
Instagram said today that it has the perpetual right to sell users' photographs without payment or notification, a dramatic policy shift that quickly sparked a public outcry.

The new intellectual property policy, which takes effect on January 16, comes three months after Facebook completed its acquisition of the popular photo-sharing site. Unless Instagram users delete their accounts before the January deadline, they cannot opt out.

Under the new policy, Facebook claims the perpetual right to license all public Instagram photos to companies or any other organization, including for advertising purposes, which would effectively transform the Web site into the world's largest stock photo agency. One irked Twitter user quipped that "Instagram is now the new iStockPhoto, except they won't have to pay you anything to use your images."

(...)

Another unusual addition to Instagram's new policy appears to immunize it from liability, such as class action lawsuits, if it makes supposedly private photos public. The language stresses, twice in the same paragraph, that "we will not be liable for any use or disclosure of content" and "Instagram will not be liable for any use or disclosure of any content you provide."

It's like they say about Facebook: you're not the consumer, you're the product being sold.

Companies controlling the internet, using people to do market research and sold their property. At some point things turned upside down.

Apparently they've backed down some on this, though to precisely what extent remains unclear.

In all honesty, this incident got me wondering if this was a new method social networking sites are employing. Like that Cisco shit about forced cloud and enabling them to collect your information discreetly, then apologize later. What I'm saying is, they tell you they wanna do it, apologize when they get flak, but in the shadows, continue with whatever they planned.

What a dick move on Facebook's part. Good to know they're backpedaling, however. To be safe, if I had a FB/IG account I'd be sure to make all pictures private.

You can be fairly certain of that. The legal regulatory scheme in almost every aspect of business is such that criminal activity can now safely be factored into the cost of doing business. Even "historic" penalties amount to something like 10% of one year's profits--the proverbial slap on the wrist.

How about some calm and some reading?

No, Instagram can't sell your photos: what the new terms of service really mean:

You realize that's a massive backtrack, right? Whether it was their intention or not, the original legalize would have allowed them to do just what people were afraid of. They've made it clearer now.

I also realize that only a fool assumes they have rights over anything they put online. But if anything this is a gesture of faith? I don't know. Not an instagram user and not concerned with my digital privacy or content ownership.

Why? I assume (and do) have the rights over my photos on Flickr, as they state, and expect royalties from Getty when they are sold (which does in fact happen, although unfortunately not that often). Many pro photographers sell their photos by them being online. Surely they are no fools?

The only thing that would have been saving grace assuming the wording hadn't been changed is that any photos with people in them could only be used editorially, and not for advertisement, as they'd have been infringing upon the models right to image. So, if I took a photo of Skykid masturbating in public and posted it to Instagram (which I would have), and Instragram used it for advertising (which they no doubt would have), I could not have sued for copyright infringement, but Skykid could have (and would have won if he was in a whitey country) for infringing on right of image. Even Japan has this law, which shows how utterly basic it is.
