Burning a copy is no worse than buying it on ebay. It's not supporting Cave or atlus anymore, it's just supporting inflated ebay prices. Burning a copy of a game that is still in print or widely available is different, but burning older games that are only available 2nd hand, especially when you plan to buy it eventually isn't too bad.
Also, I've had burned copies of saturn and psx dodonpachis, and i've never encountered the same problem that you have.

Yeah, sure. Used game stores around the world would like a word with you. As would the copyright holders. For one thing, I buy my own games and burn them so that I don't have to worry about them getting scratched up by friends or myself being careless. If I buy a game at full price, I'm not going to take the chance that I'll have to buy it again. And I DO buy the games at full price when they come out because I enjoy them for myself. I'm not talking about games that just came out either. I'm talking about games that are 10+ years old, and are widely available for FREE via MAME. If you want an actual copy, fine, be my guest. But I don't see a huge difference between burning a copy for a sega saturn game, and downloading that same game for MAME.
I've bought plenty of games on ebay for 60+ dollars from independent sellers, and I've even bought games from people on here. I just don't have a problem with a backup of a game that you plan on eventually buying. If he didn't plan on buying it, it'd be a different story, but that isn't the case.
PS. Is there a way to view the terms of service so that I can know what not to talk about if this will infact get me banned?

Really? I played dodonpachi on psx this morning in tate and on my laptop this afternoon and it looked clearer on the laptop.
