Digital Single Market Strategy for Europe

Seems great, but how will they handle games that can't be sold "as is" in Germany? Knowing the enormous influence this country has on European affairs, what stops them from selling a censored or altered version of games in a single digital store?

Wasn't Nintendo of Europe restricting 18+ eShop games to only be purchasable after a certain hour at night, in accordance with German law? I think that's been repealed since.
