Transformers Cybertron/Best Buy/Activision PITA- anybody PO?

Alrighty. I paid for War for Cybertron (Xbox)- got the version from Best Buy that was supposed to have Jazz in it. It doesn't (even though it is clearly marked on the cover). Activision support said to talk to Best Buy (who said to talk to Activision). Activision's support is getting nasty with me (even told me to purchase the stupid pre-order DLC from eBay?).

Anyways- the solution (which they don't seem to be giving me much wiggle room- even though I very clearly have the pre-order game and raised a support ticket shortly after bringing it home!) is to come up with a receipt that shows I pre-ordered. Best Buy can only re-print if you have a reward zone from what I'm told.

So- can anybody help me? (a bit of a stretch I know- but fuck going to eBay for something I pre-ordered to get! I can't even return because I opened it)

If it was described in the store or on the packaging as having something that it then turned out not to have, then it's not as described and you're legally entitled to a full refund or replacement under consumer legislation. Whether it's opened or not is irrelevent in that case; your statutory rights override store policy, and don't let the store bullshit you to the contrary.

A bit late but this is why you always get / keep receipts.

Also, fuck preorder bonuses. (Not that they can't be nice things.)

lol- yes, fuck pre-order bonuses, I was a dick for not keeping the receipt. That being said- Acti's customer support has pictures of my case, game, BB p/o specific UPC on the game, etc. They were still being difficult about it all.

I think that's their job. Justify their hourly wage to dick you out of something with so little measurable value it's a wonder they didn't just add it to everybody's game.

Yeah, it must be. It's been 8 days since I filed the ticket. Initially, the response time was less than 24 hours. Now I think the guy is just straight ignoring me. I'll give them another week, and if I can't get this resolved the way I want, then I am no longer purchasing anything new from Activision. What kind of customer support turns away a long time customer and future customer over a fucking (8-16?) digit XBL download code?

And yes, all of this stuff should've been in the games to start. I grew up with Transformers, was kinda looking forward to playing as Jazz in mp with my brothers. It left a bad enough taste in my mouth to pre-order from BB to begin with- the fact that it wasn't in the box and they are refusing to fix it is just plain insulting. I feel terrible that I've had to expend this much time over something so silly (I just do not like getting dicked around at all).

On a loosely related note- this generation has set some icky things. Namely DLC and store exclusive content. Not a fan of that stuff in most cases at all :/
