The Thunder Force developers split into two halves of good and evil, the good Tecnosoft and the evil Technosoft, along with the rights of their games. Because trying to span a copyright lawsuit would involve both halves trying to cooperate, it is unlikely too see any kind of response from them in this regard.

I have the sneaking suspicion that lawsuit wouldn't go well. Phrase is pretty generic and I don't think they ever tried to trademark it.

I'm not anything even close to a lawyer but I wanna say that since there's likely little chance of confusion between a videogame about spaceships and a film about non-spaceships then a trademark infringement suit probably wouldn't go so well.

Not sure what your point is here. Herzog is a series, not a single franchise named "Herzog Zwei". My point is that Herzog MSX is treated like it doesn't exist. A title so general may have inadvertently alienated an otherwise eager fanbase. Nobody wanted to plunk down their hard earned money to see Retsu and Lee.
Little did these people know that their favorite characters from SFII where actually in the film. You gotta go with the most popular incarnation.
I know tecnosoft is going to be swimming in yen soon, but it's still business at the end of the day.
Also, this could revitalize Werner Herzog's career.

My point is I have no idea what in this thread prompted you to make a fuss about Herzog Zwei being a sequel. Herzog Zwei had a mystique in how the storyline wasn't presented throughout the game and then the ending sequence just laid it on you, and that mystique was doubled by the fact that you could play as the good or bad guy. In light of andsuchisdeath's post I think it'd be a trip to see a fleshed out movie just about the events in Herzog Zwei.

I'm not sure. I do know that Herzog 1 has some of the same tunes. I wasn't out to prove that Herzog is the better game (in fact, it's more simplistic than 2 with levels that only scroll vertically). I only played a little bit of it. I do like the sequel quite a bit, however, though I haven't yet beaten it. I also like that the JP cart of Herzog Zwei is mostly in English.
